Welcome to TaskGenie! These Terms and Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1.1 "TaskGenie," "we," "us," or "our" refers to TaskGenie (Pty) Ltd, a private limited liability company registered in the Republic of South Africa.
1.2 "User," "you," or "your" refers to any person who accesses or uses our Services, including both Customers and Service Providers.
1.3 "Customer" refers to any User who requests and receives services through our platform.
1.4 "Service Provider" or "GeniePro" refers to any User who offers and provides services through our platform.
2.1 You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you have the legal capacity to enter into these Terms.
2.2 You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.1 To use certain features of our Services, you must register for an account. You agree to provide accurate and complete information during registration and to keep your account information updated.
3.2 You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify TaskGenie immediately of any unauthorized use of your account.
4.1 TaskGenie grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes.
4.2 You agree not to: a. Use the Services for any unlawful purpose or in any way that violates these Terms. b. Copy, modify, distribute, or disclose any part of the Services without our prior written consent. c. Use any automated system, such as robots or spiders, to access the Services. d. Interfere with or disrupt the integrity or performance of the Services.
5.1 Service Providers are independent contractors and not employees of TaskGenie. TaskGenie does not provide the services directly and is not responsible for the actions or omissions of the Service Providers.
5.2 Service Providers are responsible for obtaining any necessary licenses, permits, or certifications required to perform their services.
5.3 Service Providers agree to perform their services with due care, skill, and diligence, and to adhere to all applicable laws and regulations.
6.1 Customers can book services through our platform by selecting the desired service, date, and time.
6.2 Payment for services must be made through the TaskGenie platform. We accept various payment methods, including credit cards and other electronic payment options.
6.3 TaskGenie will process the payment and hold the funds until the service is completed. Once the service is completed, TaskGenie will release the payment to the Service Provider, minus any applicable fees.
7.1 Customers may cancel a booking in accordance with our Cancellation Policy. Refunds, if applicable, will be processed as outlined in our Refund Policy.
7.2 Service Providers may also cancel a booking in accordance with our Cancellation Policy. Customers will be notified, and TaskGenie will make every effort to find a replacement Service Provider.
8.1 Users agree to conduct themselves in a respectful and lawful manner when using the Services.
8.2 Customers agree to provide a safe and accessible environment for Service Providers to perform their services.
8.3 Service Providers agree to perform their services with due care, skill, and diligence.
9.1 Customers may leave reviews and ratings for Service Providers after the completion of a service.
9.2 Reviews and ratings must be truthful and accurate. TaskGenie reserves the right to remove any reviews or ratings that violate these Terms or our Review Policy.
10.1 TaskGenie respects your privacy and is committed to protecting your personal information. Please review our Privacy Policy for details on how we collect, use, and protect your information.
10.2 By using our Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
11.1 TaskGenie uses cookies and similar tracking technologies to track the activity on our Services and hold certain information.
11.2 You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Services.
12.1 TaskGenie may share your information with: a. Service Providers to facilitate task completion and payment processing. b. Business Partners for marketing, promotional offers, or other relevant purposes with your consent. c. Law enforcement and legal requests when required by law or in response to legal processes. d. Corporate transactions in connection with a merger, sale, or acquisition of all or part of our business.
13.1 All content and materials on the TaskGenie platform, including but not limited to text, graphics, logos, and software, are the property of TaskGenie or its licensors and are protected by intellectual property laws.
13.2 You may not use, reproduce, or distribute any content from our platform without our prior written consent.
14.1 To the maximum extent permitted by law, TaskGenie shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services.
14.2 TaskGenie is not responsible for the actions or omissions of Service Providers. Customers acknowledge that any issues or disputes with Service Providers are to be resolved directly with the Service Provider.
15.1 You agree to indemnify, defend, and hold TaskGenie harmless from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any rights of another.
16.1 TaskGenie reserves the right to terminate or suspend your account and access to the Services at any time, without notice, for conduct that it believes violates these Terms or is harmful to other Users, TaskGenie, or third parties, or for any other reason.
17.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
17.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
18.1 TaskGenie may update these Terms from time to time. If we make material changes, we will notify you by email or through our platform. Your continued use of the Services after any changes to these Terms constitutes your acceptance of the updated Terms.
